Modification of Custody/Parenting Time
As your children grow up, the custody and parenting time/visitation ordered by the court may no longer work for your family. The primary grounds for a change of custody include:
- Agreement of the parties;
- Integration (integrated into the family of the petitioner with consent of the other party);

- Persistent and willful denial or interference with parenting time.
In addition, the court must find that there has been a change of circumstances of the child or the parties since the prior order and that the modification is necessary to serve the best interests of the child. Generally, it is much easier to modify parenting time/visitation than it is to modify custody. However, if the requested modification would change your child’s primary residence, the court must find, in addition to one of the grounds for changing custody, that there has been a change of circumstances that has arisen since the prior order and that modification is necessary to serve the best interests of the child.
